The Court held that amounts relating to salaries, wages and statutory deductions could form part of the taxable consideration for the supply of outsourcing services, exposing labour outsourcing companies and their clients to potentially significant VAT liabilities and assessments for previous periods.
Parliament has now legislated a different treatment.
Through amendments to the Value Added Tax Act, the Finance Act 2026 introduced new subsections 13(5A) and 13(5B), providing that specified employee-related costs incurred by suppliers of labour, outsourcing and employee placement services, including salaries, wages and statutory deductions are treated as disbursements made on behalf of the client.
This means that, from 1 July 2026, qualifying employee-related costs are excluded from the taxable value for VAT purposes. VAT is instead charged on the service or management fees earned by the outsourcing provider.
